COMPLAINT REGULATIONS

Complaints of the KITEBOARDING.CZ e-shop are governed in accordance with the applicable legislation according to the Complaints Regulations below. We will do our best to handle the complaint in the shortest possible time and to your complete satisfaction. To speed up the entire procedure, we recommend following the procedure below:

  1. We recommend making a claim on the form Claim form. Fill it out and send to email: reklamace@kiteboarding.cz, send by mail to our contact adress or sell in person at our Ostrava store. Alternatively, you can fill out the online form below.
  2. Attach to the form: a copy of the proof of sale of the goods (tax receipt, invoice, warranty card) and, in the first stage, a photograph of the claimed goods with illustrated details describing:
    •   year, manufacturer, model, size of the claimed goods
    •   production number of the claimed goods (printed number on the leading edge of the kite, stamped number on the kiteboard, etc.)
    •   defect of the claimed goods
    Name the images (files) with the year of production+manufacturer's name+model+size+production number of the claimed goods (eg: 09-naish-cult-12m-09123123-1.jpg)
  3. Upon receipt of the complaint and based on the photos, we will decide whether it is necessary to send the claimed goods to assess the complaint - we will inform you about this at the contact you provided.
  4. Subsequently, we will inform you about the receipt of the complaint, the method of resolution of the complaint, the expected deadline for handling the complaint, or about the rejection of the claim and its reason.
  5. If the documents required by law are not supplied, or are only partially delivered, the complaint procedure cannot be initiated, or the claim will be rejected automatically within the claim period of 30 calendar days.

 

COMPLAINT RULES

  1. This complaint procedure was prepared in accordance with the provisions of Act No. 40/1964 Coll., Civil Code, No. 513/1991 Coll., Commercial Code and Act No. 634/1992 Coll., Consumer Protection Act, as amended, and applies to consumer goods for which the buyer's rights from liability for defects are applied during the warranty period.
  2. The warranty period for consumer goods is 24 months and is extended by the period during which the goods were under warranty repair. If the goods are declared by the seller as used, the seller is not responsible for defects corresponding to the degree of use or wear and tear the goods had when taken over by the consumer. The warranty period for such used goods is 12 months.
  3. The consumer can make a valid complaint in one of the following ways:
    -    by post contact adress, or seat of business
    -    by email to reklamace@kiteboarding.cz
    -    in person at contact adress
  4. When submitting a complaint, the consumer is required to documents:
    -    a copy of the document on the sale of the goods (tax document, invoice, warranty card),
    -    claimed goods with all accessories,
    -    a detailed description of the defect.
  5. At the company's premises, the consumer is issued with a receipt document for the claim.
  6. The right to claim the warranty expires in the event of:
    -    wear and tear of the thing due to its usual use,
    -    improper handling and use contrary to the instructions or user manual,
    -    damage from the elements (e.g. water, fire or lightning, etc.),
    -    damage due to excessive loading,
    -    damage to goods during transport (this claim is resolved directly with the carrier).
  7. In the event of a justified complaint, the goods are repaired by the consumer free of charge. If it is an irreparable defect, the goods are exchanged for new ones. In case of exchange of goods, a new warranty period begins.
  8. The deadline for processing a complaint, including defect removal, is 30 calendar days without undue delay, unless the parties agree otherwise. This period begins to run on the day the complaint is received. If the deadline is not met, the consumer has the right to exchange defective goods or withdraw from the purchase contract.

 

This complaint regulations becomes effective on 1.12. 2009. Changes to the complaints procedure reserved.
